Terms and Conditions

i. In these conditions the ‘Owner’ means Resource Data Marketing / Developing Data . The ‘Buyer’ means the individual, firm, company or other parties with whom the Owner contracts.

ii. Any agreement between the Buyer and a third party in relation to the list shall only be entered into with the express written permission of the Owner being first obtained and in any event it shall be a condition of such agreement that the third party be bound by the terms and conditions.

iii. Freedom of Use
Data supplied by the Owner is protected by copyright and complies with the conditions of the Data Protection Act. The use Licence granted to legitimate purchasers, allows limited use of the data which may be copied into a computer or reproduced by any other means for use in lawful sales and marketing activities in connection only in the licence holders business. Third party use must be agreed in advance by ourselves, eg. Brokers and agency.

iv. Every effort is made to supply accurate data, however, the Owner does not guarantee any campaign results. No warranty is given and no liability is accepted in the event of failure. No liability is accepted by the Owner for any loss resulting from non-delivery of mail.

v. A sample of the material to be mailed must be submitted to the Owner for approval prior to the release of the list(s) and the Owner reserves the right to refuse consent for use of list(s) for mailing such materials.

vi. The Buyer warrants that none of the items to be mailed shall contain material which is defamatory, obscene, infringes the rights of any third party, places any person in contempt of court or in breach of an obligation of confidentiality or is otherwise illegal or unlawful and the Buyer shall keep the Owner fully indemnified against all losses, costs, damages, expenses of whatever nature arising out of any actual or alleged breach of such warranty.

vii. For all genuine ‘gone aways’ returned by Royal Mail, we will credit the (rental times 3) charges providing the outer envelope, or the outer envelope and addressed item in the case of window enveloped mailings, is returned to us within 60 days of supply of the list.

viii. All of our lists are seeded with check names and addresses to detect un-authorised mailings or contact. If we discover that data rented for one time use only has been reused, users will be invoiced once again at the three times the rate as the original list rental and may take legal proceedings for copyright abuse.

ix. Lists are supplied for direct mail purposes only and not for telemarketing unless agreed beforehand.

x. List User Warranty
We require that Buyers warrant that the data will only be used by the Buyer for the purpose of advertising or direct marketing as entered by the Owner in the Data Protection Register, and these purposes are compatible with their disclosure to us, and that in the opinion of the Buyer no harm to the individuals whose names are included in the lists supplied by the Owner can result from this disclosure.

xi. List Owner Warranty
no: 161193 (Business 001056, Consumer 000875).We are a List Owner. We are registered under the Data Protection Act 1984 no: Z7889833. The data has been lawfully obtained, and/or the data has been fairly and lawfully obtained from public sources.

xii. Our Marketing Database
